KITCHENER — A middle-aged man told a judge Monday that he sexually assaulted an 87-year-old woman because he hadn’t had sex for a year and thought she might be interested.
Abdulrazah Nassary, 42, pleaded guilty in Kitchener’s Ontario Court to sexual assault and indecent exposure. He was sentenced to nine months in jail.
Nassary moved to a home in the elderly woman’s neighbourhood in July, court heard.
He would come over and join her whenever she was out in her yard. She told him several times that he was a nuisance and to stop bothering her.
Once, Nassary grabbed her buttocks and tried to bring her closer to kiss her. She pushed him away and told him she wanted nothing to do with him.
Several other times, he rubbed up against her and touched her. She thought he wanted to have sex with her, court heard.
Nassary showed up again on Aug. 5 as she was removing weeds from her grass. He told her to look at him.
When she did, she saw his penis was exposed, and turned away. He eventually left.
That night, a friend of the woman’s was driving past her home when she saw a man on the front lawn hiding behind a bush.
The elderly woman was outside but didn’t seem to know a man was watching her. Her friend alerted her and police were called.
Nassary continually shook his head as the facts were read out. When the prosecutor said he had stolen the woman’s sense of security, he shrugged.
The explanation of his desire for sex after being celibate for a year was given by duty counsel Paul Borges.
The woman, who can’t be identified by court order, said she felt violated. She felt safer once he was arrested.
She said she now locks her doors more often than she used to.
Nassary came to Canada in 2006 from Eritrea and is a landed immigrant. He told the judge he plans to rturn to his home country since he assumes he’ll be deported anyway.
He was on probation at the time of the offence for possessing drugs and theft. He was receiving welfare.
Justice Don Downie gave him credit for pleading guilty and sparing the victim from having to testify in court.
